This Policy is intended to prevent unlawful, harmful, fraudulent, and other abusive use of the Services.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>1. Status of the Policy and Relationship to Other Documents<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">This AUP forms part of PROSOX&#8217;s contractual and compliance framework and applies together with the Terms of Use, Privacy Policy, Cookie Policy, and Ethics Policy published on the Proxyma website.<\/p>\n\n<p class=\"wp-block-paragraph\">By using the Services, the user agrees to comply with this AUP. Where a specific agreement, order, corporate agreement, or other special terms establish stricter acceptable-use requirements, such stricter requirements shall apply to the relevant extent.<\/p>\n\n<p class=\"wp-block-paragraph\">Terms not defined in this AUP shall have the meaning ascribed to them in the applicable Terms of Use or the relevant agreement with PROSOX.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>2. Scope of Application<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">This Policy applies to all users, customers, resellers, contractors, and other persons who directly or indirectly obtain access to the Services, including access through accounts, APIs, integrations, proxy servers, IP addresses, or other technical means.<\/p>\n\n<p class=\"wp-block-paragraph\">The customer is responsible for the use of the Services by persons to whom it grants access, and is obligated to take reasonable measures to prevent unauthorized use of its account and credentials.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>3. Fundamental Principle of Acceptable Use<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">The Services may be used only for lawful purposes and in a manner that does not infringe the rights of third parties, applicable law, mandatory requirements of competent authorities, contractual restrictions, or this Policy.<\/p>\n\n<p class=\"wp-block-paragraph\">PROSOX does not grant permission for actions that are inherently unlawful or that require consent, a license, or other legal basis. The technical ability to perform an action through the Services does not imply that such action is permitted.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>4. Prohibited Use<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">It is prohibited to use the Services to commit, facilitate, prepare, conceal, or scale unlawful or harmful activity.<\/p>\n\n<p class=\"wp-block-paragraph\">In particular, the following are prohibited: unauthorized access to systems, accounts, networks, or data; circumvention of authentication or access control mechanisms; distribution of malicious software (malware); phishing; credential stuffing; exploitation of vulnerabilities without proper authorization; denial-of-service (DoS\/DDoS) attacks; botnet activity; and other actions aimed at disrupting the operation of information systems.<\/p>\n\n<p class=\"wp-block-paragraph\">Fraud, impersonation, the creation or use of fake accounts for unlawful purposes, payment fraud, the unlawful acquisition of goods, services, funds, or digital assets, and facilitation of such actions are prohibited.<\/p>\n\n<p class=\"wp-block-paragraph\">The distribution of unsolicited bulk messages, spam, unlawful marketing, automated communications in violation of applicable rules, and the collection of contact data for such activity are prohibited.<\/p>\n\n<p class=\"wp-block-paragraph\">The unlawful collection, interception, purchase, sale, disclosure, or other processing of personal data, credentials, payment information, confidential information, trade secrets, or other protected data is prohibited.<\/p>\n\n<p class=\"wp-block-paragraph\">Infringement of copyrights, trademarks, database rights, trade secrets, and other intellectual property rights is prohibited.<\/p>\n\n<p class=\"wp-block-paragraph\">Use of the Services to distribute materials prohibited under applicable law, or for activity that directly facilitates the exploitation of children, human trafficking, terrorist activity, or other serious unlawful activity, is prohibited.<\/p>\n\n<p class=\"wp-block-paragraph\">Deliberate use of the Services to evade sanctions, export control restrictions, mandatory AML\/CFT (anti-money laundering\/countering the financing of terrorism) requirements, or other applicable legal restrictions is prohibited.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>5. Automated Access, Scraping, and Data Collection<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">Automated access, web scraping, crawling, indexing, monitoring, and other forms of automated data collection are permitted only where a lawful basis exists and subject to compliance with applicable law, third-party rights, and mandatory technical or contractual restrictions.<\/p>\n\n<p class=\"wp-block-paragraph\">The user is solely responsible for determining the lawfulness of a particular method of collection and subsequent use of data. The Services must not be used to circumvent authentication, obtain access to private data, infringe personal data rights, or engage in other unlawful means of access.<\/p>\n\n<p class=\"wp-block-paragraph\">PROSOX reserves the right to apply reasonable technical restrictions to protect its infrastructure, the stability of the Services, third parties, and to prevent abuse.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>6. Network Security and Load<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">The user must not generate excessive, anomalous, or malicious load capable of disrupting the operation of the Services, PROSOX&#8217;s infrastructure, providers, or third parties.<\/p>\n\n<p class=\"wp-block-paragraph\">Interference with the operation of the Services, attempts to gain unauthorized access to PROSOX&#8217;s internal infrastructure, circumvention of established limits or technical protection measures, and concealment of abuse through resource rotation or other mechanisms are prohibited.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>7. Resellers and Provision of Access to Third Parties<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">Where a customer resells, integrates, or otherwise provides access to the Services to third parties under a model permitted by PROSOX, it shall ensure that requirements substantially no less strict than this AUP are applied to such persons.<\/p>\n\n<p class=\"wp-block-paragraph\">A reseller or customer is not released from liability to PROSOX for violations committed through accounts, API access, or resources provided to it, to the extent such liability is established under the applicable agreement and law.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>8. Abuse Reports and Interaction<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">PROSOX may receive and review reports of alleged abuse of the Services from users, rights holders, infrastructure providers, platforms, competent authorities, and other third parties.<\/p>\n\n<p class=\"wp-block-paragraph\">In reviewing an incident, PROSOX may request from the customer information reasonably necessary to identify the traffic, user, purpose of use, or circumstances of the incident. The customer shall cooperate in good faith to the extent permitted by applicable law and contractual obligations.<\/p>\n\n<p class=\"wp-block-paragraph\">Reports of alleged abuse may be submitted through the contact channels published on the Proxyma website. Requests relating to personal data shall be handled in accordance with the Privacy Policy.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>9. Measures in the Event of Violation<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">Where there are reasonable grounds to believe that the Services are being used in violation of this AUP, PROSOX may take proportionate measures, including issuing a warning, requesting information, restricting specific functions or resources, temporarily suspending access, or terminating provision of the Services in accordance with the applicable Terms of Use, agreement, and law.<\/p>\n\n<p class=\"wp-block-paragraph\">In urgent cases, including a security threat, an ongoing attack, or a material risk to infrastructure, users, or third parties, PROSOX may take necessary protective measures without prior notice, where reasonable and permitted under the applicable terms and law.<\/p>\n\n<p class=\"wp-block-paragraph\">PROSOX may retain and disclose information in the cases and to the extent provided for by applicable law, the Privacy Policy, and mandatory lawful requests from competent authorities.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>10. No General Monitoring Obligation<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">Unless otherwise required by law or specific contractual obligations, this AUP does not, in and of itself, impose on PROSOX an obligation to conduct general monitoring of all user traffic or to review each user action in advance.<\/p>\n\n<p class=\"wp-block-paragraph\">The application of technical security measures, anti-abuse mechanisms, investigation of specific incidents, or response to substantiated reports does not constitute an assumption by PROSOX of liability for the actions of users.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>11. Compliance with Law and Third-Party Rights<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">The user is solely responsible for assessing the requirements applicable to its activity, including rules on data protection and privacy, intellectual property, e-commerce, cybersecurity, sanctions, and other regulated areas.<\/p>\n\n<p class=\"wp-block-paragraph\">Where use of the Services affects multiple jurisdictions, the user shall take into account the applicable requirements of each relevant jurisdiction. Reference to PROSOX&#8217;s global presence does not mean that any use of the Services is automatically permitted in all countries.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>12. Global Presence<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">PROSOX LLC is a company incorporated in the State of Delaware, USA. PROSOX\/Proxyma may conduct global commercial, technical, and operational activity, including presence and business contacts in various jurisdictions.<\/p>\n\n<p class=\"wp-block-paragraph\">Reference to a geographic or operational presence, including in Hong Kong and Vietnam, does not, in and of itself, constitute the establishment of a separate legal entity, branch, or registered representative office of PROSOX in the relevant jurisdiction, unless expressly stated otherwise.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>13. Amendments to the Policy<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">PROSOX may periodically update this AUP to reflect changes to the Services, security threats, industry practice, contractual requirements, and law.<\/p>\n\n<p class=\"wp-block-paragraph\">The current version is published on the Proxyma website, indicating the effective date or date of last update. Continued use of the Services after amendments take effect shall constitute acceptance of the updated version to the extent permitted by law and the applicable agreement.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>14.
